ALL RESERVATIONS WILL BE PAID 100% AT THE TIME OF THEIR MAKE.
THE MINIMUM PERIOD FOR A RESERVATION IS 3 DAYS, EXCEPT FOR THOSE MADE BY EMPLOYEES ON SITE
The client rents equipment/s from Formentera ProBikes, subject to all the terms and conditions of this contract:
1. PAYMENT METHOD FOR IN-STORE RESERVATIONS: Cash or card accepted upon delivery of the equipment and for the total duration of the rental contract. Online reservations have the secure POS system via credit card as the only payment method.
2. DEPOSIT: At the time of delivery of the equipment, the client will be required to present an identity document such as a passport, or National Identity Card in the case of European citizens. A security deposit may be required. The deposit will be returned once the rental period has ended upon delivery of the rented equipment.
3. SIGNATURE: The person signing the rental contract must be over 18 years of age and will be responsible for the rented equipment.
4. USE OF THE RENTED EQUIPMENT: The rental equipment can only be used by the clients named in the rental contract. The client is obliged to take good care and take all necessary precautions to protect the rented equipment from damage, loss or theft. If any of the above situations occur during the rental period, the client will immediately assume all replacement costs incurred at market prices. At the end of the rental period, a representative of Formentera ProBikes will assess any losses or damages incurred. The client is obliged at all times to properly secure the equipment and other material when it is not in sight (lock the frame, saddle and wheels and tie the bicycle to a post fixed to the ground or bike-parking). It is recommended in all cases to keep the equipment with you as long as possible.
5. RETURN OF EQUIPMENT: The lessee will return the rented equipment together with all its accessories at the stipulated place, date and time. Any alteration must be previously authorized by the lessor. Failure to comply with this condition entitles the lessor to legally require the return of the equipment.
Formentera ProBikes may at any time demand payment for the days exceeded in the reservation without prior contracting, up to a maximum of €600.
6. RESPONSIBILITIES
6.1. LIABILITY AND LIMITATIONS: The renter will be responsible for all personal and material damages including those resulting from accidents and civil liability, as well as damages due to negligence, gross negligence or intentional negligence. The renter will be responsible for damages, losses or non-performance during the rental period. It will be the renter's responsibility to pay the amount indicated, calculated on the current retail price rate of the lessor. In the case of damages based on intentional wrongful acts or gross negligence, the renter will be responsible for the costs and repair and replacement parts.

6.2. RESPONSIBILITY FOR THEFT: The lessee will also be responsible to the lessor for theft or any other loss of the bicycle. In the case of theft, the lessee will be responsible for the amount of the current price of the lessor's sales rate. The rental price paid by the lessee will be deducted from the total price.
6.3. RENTER'S LIABILITY EXCLUSION (INSURANCE): claims by the lessor for damages due to accidents may be excluded for an additional fee paid by the lessee. This will be based on insurance per day and will be paid at the time of signing the contract.
7. LANDLORD'S LIABILITY: The lessor declares that it has taken the necessary precautions to avoid mechanical failures of the rented equipment, but in the event of these occurring, it assumes no responsibility for any damages that may be caused directly or indirectly to the lessee as a result of said failures or breakdowns.
8. RENTAL DURATION: Minimum rental period 3 days if rented online and 1 day if rented in a store.
9. It is the responsibility of the client and his/her companion(s) to respect Spanish traffic regulations.
10. The contract is governed by Spanish law. The place of jurisdiction will be exclusively the Balearic Islands, Spain.
11. CANCELLATIONS:
11.1. A 100% refund will be made if the reservation is cancelled 30 days before the start of the reservation. Not applicable to reservations already previously postponed due to special COVID conditions.
11.2. A partial refund of 50% will be made when: The notice is made 29 and 15 days before delivery. Not applicable to reservations already previously postponed due to special COVID conditions.
11.3. No amount will be refunded in the last 14 days prior to the reservation.
11.4. Customers with postponed reservations and pending dates must pay the price difference at the time of the new confirmation of dates, either due to a change of model due to unavailability or a difference in rates from previous years.
11.5. All postponed reservations pending a date cannot be extended beyond the current year.
11.6. The management fees for cancellation of reservations have a cost of €10.
